Partial COD Orders, Failed Delivery, Return & Refund Policy

1. Partial COD Orders

 

For certain heavy machinery orders, Nirali Food Machinery may offer Partial COD, where the customer pays a booking/advance amount online, and the remaining balance is payable at the time of delivery.

2. What "Free Delivery" Means

 

Although machines may be marketed on the website as "Free Delivery," the customer understands and agrees that these are heavy commercial/industrial machines and actual transportation/logistics charges are incurred by the company.

"Free Delivery" means that standard outward transportation charges are included/subsidised by Nirali Food Machinery for successful delivery and are not charged separately to the customer at the time of order.

3. Customer-Attributable Failed Delivery / Return to Origin (RTO)

 

If a Partial COD order is dispatched and the shipment is returned to Nirali Food Machinery due to any customer-side reason, including but not limited to:

  • The customer is not answering calls from the courier/transporter
  • The customer is unavailable at the delivery address
  • Incorrect/incomplete delivery address or contact details provided by the customer
  • Refusal to accept delivery
  • Non-payment of the COD balance amount
  • Any other reason not attributable to Nirali Food Machinery

Then the order will be treated as a customer-attributable failed delivery / Return to Origin (RTO).

4. Refunds on RTO Orders

 

In such cases, if the customer requests a refund, the refund will be processed only after the machine is received back at our facility and inspected. The following amounts will be deducted from the amount already paid by the customer:

  1. Outward transportation/logistics cost incurred for dispatching the machine
  2. Return transportation/RTO cost charged by the transporter
  3. Any applicable loading/unloading, handling, or re-packing cost, if actually incurred
  4. Any repair/replacement cost if the machine or packing is found damaged after return due to transit/customer-side handling

The balance amount, if any, will be refunded to the customer through the original mode of payment or any other mutually agreed payment method within a reasonable time after inspection.

5. Re-Dispatch of the Same Machine

 

If the customer still wants the same machine to be delivered again after it has been returned to Nirali Food Machinery, the customer must pay the applicable re-dispatch transportation charges in advance before the machine is shipped again.

6. No Full Refund / Free Replacement on Customer-Attributable RTO

 

For Partial COD orders returned due to customer-attributable failed delivery/RTO, the customer shall not be eligible for:

  • A full 100% refund
  • Free replacement
  • Free re-dispatch

7. Statutory Rights

 

This clause shall not affect the customer's statutory rights in cases where the product delivered is proven to be defective, deficient, materially different from the product description, or otherwise required to be taken back/refunded under applicable Indian consumer protection laws.

Under the Consumer Protection (E-Commerce) Rules, sellers cannot refuse a refund/return where goods are defective, deficient, spurious, not as advertised/agreed, or delivered late as per the stated delivery schedule.
